Don Weber of CLG recently obtained a full defense verdict in a medical malpractice case. Weber was co-counsel for the defendant physician in a matter where plaintiff alleged that the defendant failed to properly diagnose the possibility of a blood clot, and failed to prescribe anti-clotting medication. The defense argued that the blood clot – which allegedly resulted from a sprained ankle – was an unforseeable anomoly, and that the applicable standard of care did not require the prescription of anti-clotting medication.
