The firm recently defended a fast food franchise at a bench trial, in a claim brought in the Circuit Court for St. Louis City, Missouri. In the claim, the plaintiff alleged that he purchased food which was tainted with an insect, causing severe illness and food poisoning, resulting in hospital treatment. Plaintiff pushed for a settlement. The firm defended the claim on the merits, arguing at trial that there was no liability, and that plaintiff could not prove that any acts or omissions of the defendant proximately caused the alleged illness. Judgment in favor of defendant was granted, with costs taxed to the plaintiff. Case was tried by Nicole Winters, parter at the firm.
